The learned Senior Counsel appearing on behalf of the writ petitioner management made a submission that the respondents workmen filed miscellaneous petitions in W.M.P.Nos.2721, 2714, 2706, 2702, 2698, 2728, 2725 of 2020 for payment of last pay drawn, under Section 17B of the Industrial Disputes Act.

2. The petitioner management has filed an affidavit establishing that the respondents workmen are employed elsewhere and some of them are doing business. Therefore, they are not entitled for the benefit under Section 17B of the Industrial Disputes Act.

3. At this juncture, the learned counsel appearing on behalf of the respondents workmen, has chosen to withdraw the miscellaneous petitions filed to award the last drawn wages under Section 17B of the Industrial Disputes Act. Accordingly, the respondents workmen are permitted to

withdraw the miscellaneous petitions filed by them. Therefore, W.M.P.Nos.2721, 2714, 2706, 2702, 2698, 2728, 2725 of 2020, filed by the respondents workmen stand dismissed as withdrawn. As a consequence, W.M.P.Nos.29886, 28238, 28236, 29885, 28232, 28245, 28241 of 2021 filed by the petitioner Management for modification of the order granting payment in terms of Section 17B of the Industrial Disputes Act, stand closed since the said order ceases to operate now. There will be no order as to costs.

Post the writ petitions after two weeks.
