Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus to direct directing the 1st respondent to consider and pass orders on the petitioner's appeal petition dated 22.11.2025 seeking to set aside the order of the 2nd respondent in proceedings having reference Pa.Mu.5659/2023/B1 dated 21.4.2025 within a time framed to be fixed by this Court.

Order This Writ Petition has been filed seeking for a limited relief.

2. The petitioner seeks for an early disposal of his Appeal dated 22.11.2025 pending on the file of the first respondent.

3. Aggrieved by the order of the second respondent dated 21.04.2025, the petitioner has preferred the aforesaid Appeal dated 22.11.2025 before the first respondent.

4. Mr.C.Jayaprakash, learned Government Advocate accepts notice for respondents 1 to 3. Since no adverse orders are being passed against the private respondent, viz., fourth respondent, notice to him in this Writ Petition is dispensed with by this Court.

5. No prejudice would be caused to the respondents, if a direction is issued to the first respondent to dispose of the Appeal dated 22.11.2025 filed by the petitioner on merits and in accordance with law after hearing the objections of the fourth respondent and any other third party, whom, the first 2/4

respondent deems it fit to enquire within a time frame to be fixed by this Court by adhering to the principles of natural justice. This Court is not expressing any opinion on the merits of the Appeal filed by the petitioner dated 22.11.2025.

For the foregoing reasons, this Writ Petition is disposed of by directing the first respondent to dispose of the Appeal filed by the petitioner dated 22.11.2025 aggrieved by the order of the second respondent dated 21.04.2025 on merits and in accordance with law after hearing the objections of the fourth respondent and any other third party, whom, the first respondent deems fit to enquire by adhering to the principles of natural justice within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
