2024-03-04Honourable Mrs.Justice N. Mala2 pages

W.M.P.No.1247 of 2024 in W.P.No.6221 of 2023 W.M.P.No.1247 of 2024 in W.P.No.6221 of 2023 N.MALA,J.

The application is filed under section 17-B of the I.D Act for payment of last drawn wages of Rs.22,401.70/- to the petitioner, pending disposal of the Writ petition under section 17-B of the I.D Act. The petitioner has in his sworn affidavit, categorically stated that he was not gainfully employed ever since he was sent out of employment by the respondent. The respondent has not denied the said averment in the counter. The only contention raised in the counter is that it will cause financial burden on the Corporation, if the petitioner's petition is allowed. Even the last drawn wage claimed at Rs.22,401.70/- is not denied by the respondent.

2. 2. In view of the above, a direction is issued to the respondent to pay the petitioner, the last drawn wage of Rs.22,401.70/- starting from this month and every month thereafter, till the disposal of the writ petition. 04.03.2024 1/2 https://www.mhc.tn.gov.in/judis
