ORDER

This Criminal Original Petition is filed seeking to call for the records pertaining to the case in C.M.P. No.8 of 2016 on the file of the Judicial Magistrate Court No.III, Erode and District and quash the same.

Heard the learned counsel for the petitioners and the learned counsel for the respondent.

On 08.06.2016, this Court granted interim order on condition that the petitioners 1 to 3 shall ensure that V. Sankar deposits a sum of Rs.3,000/- per month to the credit of C.M.P. No.8 of 2016 on the file of the Judicial Magistrate Court No.III, Erode, as ad interim maintenance.

It appears that the aforesaid order passed by this Court has not been complied with. Under such circumstances, this Criminal Original Petition is dismissed. However, if the petitioners file an application before the Trial Court for dispensing with their presence on condition that their counsel will crosshttps://hcservices.ecourts.gov.in/hcservices/

examine the witnesses and not protract the trial, the Trial Court is directed to consider the same liberally. Connected Crl.M.P. is closed.
