[Order of the Court was made by S.S.SUNDAR, J.] The learned counsel for the petitioner seeks permission of this Court to withdraw the above miscellaneous petition. He has also made an endorsement in the petition to that effect.

2.In view of the submission and endorsement made by the learned counsel for the petitioner, this Criminal Miscellaneous Petition stands dismissed as withdrawn.

3.Considering the fact that the petitioner / appellant is undergoing incarceration for more than seven years, Registry is directed to make the typed set of papers ready and post the Criminal Appeal for final hearing during first week of January 2024.
