Respondent Prayer:- The Criminal Original Petition is filed under Section 482 of Cr.P.C. praying to direct the respondent to file final report in Criminal No.5/2013/AC/CB pending before the Special Court for the cases under prevention of Corruption, Coimbatore within a stipulated period as deem fit and proper.

O R D E R

The case of the petitioner is that while he was working as Electrical Inspector in Electrical Department, Government of Tamil Nadu at Tiruppur

during the period between 01.01.2007 and 31.07.2010, a case was registered by the District Vigilance and Anti-Corruption, alleging that he was possessing disproportionate assets to the known sources of income. The case was registered under Crime No.5/2013/AC/CB for offence under Section 13(2) r/w.Section 13(1)(e) of Prevention of Corruption Act. So far, no final report has been filed, inspite of the petitioner being summoned and statements recorded as early as on 09.03.2015. The petitioner has attained superannuation on 30.06.2017, but he was not allowed to get retired from service due to the pendency of criminal case under investigation. Hence, seeks for a direction to the respondent-police to complete the investigation and file the final report, so that he will be able to get back his retirement benefits, which is now been being with held.

2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondent representing District Vigilance and Anti-corruption Department.

3. The learned Government Advocate submits that investigation is completed and for sanction to prosecute the accused, the investigation agency has sought the order from the competent authority, and it is awaited.

4. Considering the plea made in the petition and the representation made by the learned Government Advocate, it is suffice to direct the respondent-police to file the final report within a period of two months from the date of receipt of a copy of this order.
