Malini Pandi v. No Respondent
O.P.No.281 of 2024 RMT.TEEKAA RAMAN, J., This original petition has been filed under Sections 372 of Indian Succession Act XXXIX of 1925 Read with Order XXV Rule 6 of the High Court O.S.Rules, seeking Succession Certificate with respect to the securities in the name of V.Palani Pandi who had died on 25.07.2021. The property is situated within the jurisdiction of this Court
2. The said deceased at the time of death, left behind him surviving as his class I heirs and next-of-kin, 1.Mrs.Rukmani Pandi (wife) 2.Mrs.Malini Pandi (petitioner herein). The said Mrs.Rukmani Pandi, wife of deceased and mother of the petitioner died on 03.10.2022 at Chennai.
3. The legally adopted daughter of Late V.Palani Pandi and Mrs.Rukmani Pandi. A Registered Adoption Deed has been entered into between the natural parents and adopting parents of the petitioner on 08.11.1989, registered as Document No.225/1989, in the office Sub Registrar, Tallakulam. From the day of one of adoption, petitioner was living with the adopted parents and in her school records, passport, bears the adopted parent's name. The Legal Heir Certificate also issued stating that she is adopted daughter of the deceased V.Palani Pandi.
4. Paper Publication has been effected.
5.After following due procedure, the petitioner is invited to tender evidence. Accordingly, the petitioner was examined as P.W.1 and marked as Exs.P1 to 11.

7. From the oral documentary evidence, I find no impediment for grant of succession certificate.
8. Accordingly, this Original Petition stands allowed. The Succession Certificate may be issued to the petitioner, in accordance with the rules. 11.09.2024 nvi RMT.TEEKAA RAMAN, ,J.
