Both these Criminal Miscellaneous Petitions have been filed to incorporate the actual offences, which had been included by the respondent at the time of filing the charge sheet. 2.Bail had been granted to the petitioners on the basis of the offences shown in the First Information Report. The major offence was under Section 302 IPC. At the time when bail was granted, it was granted for the offences punishable under Sections 147, 148, 341, 294(b) and 302 IPC.

3.The petitioners are A5 and A8. Subsequently, when charge sheet has been filed, the accused have charged for the offences under Sections 120(B), 147, 148, 341, 342, 294(b), 352, 506(ii), 109 and 302 IPC r/w Section 149 IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002.

4.In view of the fact that originally when bail was considered, the major offence under Section 302 IPC had been taken into consideration, these amendment petitions stand allowed. 1/2 https://www.mhc.tn.gov.in/judis

smv 5.In Crl.M.P.No.253 of 2024 which had been filed in Crl.O.P.No.29239 of 2023, one further amendment is sought namely, the date of remand which was given 28.06.2023 instead of 13.07.2023. 6.Fresh order copy to be issued in Crl.O.P.No.29266 of 2023 incorporating the offences as mentioned above and in Crl.O.P.No.29239 of 2023 incorporating the same offences as stated above and also the date of remand as 13.07.2023.
