PRAYER Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of a Writ of Mandamus, directing the respondents 1 to 3 to take all necessary steps to ensure the disbursement of the petitioner's rightful share of the Death-Cum-Retirement Gratuity (DCRG) and other service benefits of the late K.Gandhimathi, consequently, direct the 4th Respondent to pay the petitioner her rightful share of the DCRG, which was exclusively disbursed to him, along with all other amounts due to the petitioner, directing the 1st to 3rd respondents to investigate the circumstances under which the entire DCRG amount was sanctioned and disbursed solely to the 4th respondent, contrary to the nomination in the service Register and the legal heir status of the petitioner. ORDER
This Writ Petition has been filed seeking to direct the respondents to disburse the petitioner's rightful share of the Death-Cum-Retirement Gratuity (DCRG) and other service benefits of late K.Gandhimathi.
2. Mr.T.M.Rajangam, learned Government Advocate takes notice on behalf of the respondents 1 to 3. Mr.T.Ravikumar, learned counsel takes notice
on behalf of the fourth respondent. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.
3. Since no adverse orders have been passed against the fourth respondent, notice to the fourth respondent is dispensed with.
4. The case of the petitioner is that the petitioner is the elder daughter of Late K.Gandhimathi, who served as an Assistant in the office of the first respondent. She died in harness on 15.10.2024. When she was alive, she had officially nominated both the petitioner and her brother / the fourth respondent herein as nominees in her Service Register. It is the grievance of the petitioner that the first respondent forwarded a proposal to the second respondent to disburse the Death-Cum-Retirement Gratuity (DCRG) to both the legal heirs. However, the second respondent, disbursed the entire DCRG amount to the tune of Rs.21,88,971/- to the fourth respondent. Despite the fourth respondent, having executed a No Objection Certificate in favour of the petitioner, the second respondent failed to disburse the share of the deceased to the petitioner. Therefore, the petitioner made a representation dated 23.09.2025 before the respondents. However, the same has not been considered till date. Therefore, the petitioner has preferred the present Writ Petition.
5. Learned Counsel appearing for the petitioner submits that it would suffice, if this Court issues a direction to the respondents to consider the representation of the petitioner dated 23.09.2025 and pass appropriate orders on the same within the time that may be stipulated by this Court.
6. On the above contention, this Court heard the learned counsel appearing for the respondent.
7. In view of the limited relief sought for by the petitioner, this Court without expressing any opinion on the merits of the case, directs the respondents to consider the petitioner's representation dated 23.09.2025 and pass appropriate orders on the same in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and any other interested parties.
8. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
