V.Arunagiri v. Mr A.M.Gopalan
Application No. 5431 of 2010 in C.S.No.668 of 2005 N. SATHISH KUMAR, J.
This application has been filed to issue arrest warrant against the Revenue Officer (LB), Corporation of Chennai, Rippon Buildings, Chennai mainly on the ground that the Revenue Officer has not produced the documents sought to be produced before this court.
2. Heard both sides.
3. A perusal of the application shows that the applicant wants to prove the fact that the Revenue Officer of the Corporation of Chennai had received the application for the shop license on 10.10.2000 with a demand draft, given by the applicant.
4. The learned counsel appearing for the respondent submitted that they never disputed neither receiving the application given by the applicant nor issuance of the license in favour of the applicant.
5. When the document sought to be marked itself is not disputed by the respondent, I am of the view that the question of issuing arrest warrant or summoning the Revenue Officer (LB), Corporation of Chennai does not arise at all.
6. Accordingly, this petition is dismissed.
