This application has been filed seeking interim visitation right to the petitioner/father of a minor male child, viz., G.Keerthivasan, who is now aged about 11 years.

2. In the affidavit filed in support of this petition, it had been contended that the respondent suffers from serious complexes and is delirious and that the respondent had never assisted the child in his school work and that she is very rude and aggressive and lacks patience to deal with a young child. But unfortunately in the counter, it has been stated that it is the petitioner herein, who had desserted the respondent for nearly about 9 years, from when the child was 2 years young and the respondent had been bringing up the child from his age of 2 years till now the age of 11 years.

3. It is stated that even in the application seeking dissolution of marriage, the petitioner had not effectively participated and had not filed any application seeking for interim custody of child or sought arrangements to be made for custody of the child.

4. It is also contended that the child is now 11 years and he is going to school and it would be very difficult for him to accept the presence of the petitioner.

5. Taking into consideration the two averments made, in view of the fact that it will only be adviseable that the trial could be commenced in the main original petition and final resolution could be given to the issue of guardian original petition, this application seeking interim custody stands dismissed.
