V.Arunagiri v. Mr A.M.Gopalan
Application No. 5432 of 2010 in C.S.No.668 of 2005 N. SATHISH KUMAR, J.
This application has been filed to issue subpoena to the Inspector of Police, XII Team, Central Crime Branch, Egmore, Chennai-8 to produce all the original documents and certified copies received by them from the applicant in Crime No.X.Cr.No.500 of 2002 and give evidence.
2. Heard both sides.
3. It is the contention of the applicant that during the year 2002, he lodged a complaint and handed over various original and certified copies of the documents to the Inspector of Police, Central Crime Branch, to prove his case and therefore, those documents are required to be produced.
4. Entire perusal of the application shows that no details and nature of the documents whatsoever were given by the applicant. Admittedly, the complaint given by the applicant was stated to have been closed as " mistake of facts" by the then investigation agency. Against which, an application filed by the applicant was also dismissed. It appears that a revision in CRP No.605 of 2003 filed by the applicant before this court also disposed of on 25.11.2009 and the order copy was also filed.

5. Such being the position, I am of the view that summoning the Inspector of Police, XII Team, Central Crime Branch, Egmore, chennai, will not help in any manner, especially, when the petitioner himself has not figure out the nature of documents handed over by him to the Inspector of Police, at the relevant point of time. Therefore, issuing subpoena to the Inspector of Police, XII Team, Central Crime Branch, cannot be ordered, without any details of the documents.
6. Accordingly, this petition is dismissed.
