10044/2018] [ii]exemption surrender before the trial court against order passed by the by the II Additional District Sessions Judge, Erode in C.A.No.22 of 2018 dated 14.06.2018 confirming in S.T.C.No.125/2016 dated 05.01.2018 on the file of the Judicial Magistrate,{fast Track} No.1,Erode and pending disposal of the above Criminal revision peititon and thus render justice.[CRL.MP.NO.10046/2018] Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.Revision Case No.884/2018 on the file of the High Court and upon hearing the arguments of M/S.E.C.RAMESH Advocate for the petitioner , the court made the following order:- This petitioner was convicted by the trial Court for the offence under Section 138 of Negotiable Instrument Act 2012 and sentenced to undergo six months S.
I and imposed with compensation of Rs.4,00,000/-, in default in payment of fine sentenced the accused to undergo simple imprisonment for a period of one month to the respondent/complainant. Challenging the said conviction and sentence, pending revision, the petitioner has filed the present petition.
2. The sentence of the imprisonment imposed on the petitioner shall stand suspend on condition that the petitioner shall deposit for a sum of Rs.2,00,000/- awarded by the Court below as compensation within a period of eight weeks from today and on such deposit, the petitioner shall release on bail on his executing a bond for a sum of https://hcservices.ecourts.gov.in/hcservices/
Rs.10,000/- with two sureties each for a likesum to the satisfaction of the trial Court and on a further condition that the petitioner shall report before the trial Court on the first working day of every month at 10.30 a.m, pending disposal of the revision.
3.
