2. Mr.C.Prabakaran, learned counsel on record for petitioner adverting to support affidavit and more particularly paragraph Nos.5 and 6 thereat submits that family members of the petitioner initially did not show interest in filing an appeal against the order of conviction passed qua the petitioner, the petitioner had to convince his family members to file an appeal and now they have taken steps to file an appeal.
3. Considering the facts and circumstances of the case and other averments in the affidavit, we are convinced that this is a fit case to accede to COD prayer.
