M.DHANDAPANI.J, Today, the matter is listed under the caption for 'being mentioned', at the instance of the learned counsel for the petitioners.
2. The learned counsel for the petitioners would submit that one Varadharajan, 1st petitioner in Crl.OP.No.26390 of 2012 had already passed away. He would further submit that this Court has already ordered dispensing with the appearance of the 2nd petitioner in Crl.O.P.No.27611 of 2012, namely, Vasantha. However these aspects have not been reflected in the order dated 19.12.2019 made in Crl.OP.Nos. 26389, 26390, 27611 & 30205 of 2012. Hence, the learned counsel prays for appropriate orders.
3. In view of the submission made by the learned counsel for the petitoners, Registry is directed to incorporate the above in the following portion of the order dated 19.12.2019 made in Crl.OP.Nos. 26389, 26390, 27611 & 30205 of 2012:
"in paragraph 5 (end portion) ......... The learned counsel further submits that this Court may issue a direction to the 1/3
concerned Court to fix a date for the appearance of the parties. He would further submit that one Varadharajan, 1st petitioner in Crl.OP.No.26390 of 2012 had already passed away.
in paragraph 6 ................ The parties are also directed to appear before the Court on the said date without fail, except, the 2nd petitioner in Crl.O.P.No.27611 of 2012, namely, Vasantha. However, the said Vasantha shall appear before the said Court as and when summoned by the learned Judicial Magistrate. The learned Judicial Magistrate is further directed to dispose of the case as expeditiously as possible."
4.Registry is directed to carry out the necessary corrections and re-issue copy of the order to the respective learned counsel appearing for the parties.
