ORDER
(Order of the Court was made by G.Jayachandran J.) The Writ Petition is filed alleging that the water canal in S.No.1782 has been unauthorizedly encroached upon by the second respondent.
2. The learned Government Advocate states that, as per Survey Report, the canal does not run through S.No.1782. The said S.No.1782 has been classified as private land and patta has been assigned to various individuals.
3. The learned counsel appearing for the petitioner states that there was an error in mentioning the survey number. However, the Town Survey Register would clearly show that the canal runs through S.No.1783 and not Survey No.1782.
4. The Town Survey Land Records entry, extracted in the affidavit filed by the District Collector, Cuddalore reads as below:-
Sl.No.
Town Survey No.
Old Survey Classification Extent (Sq.ft) Name of the No.
Pattadar 1.
1782/1 1782/1 R.Punjai 00559.0 Radhakrishnan S/o.Govindasamy 2.
1782/2A 1782/2 R.Nanjai 00759.5 Radhakrishnan S/o.Govindasamy 3.
1782/2B 1782/2 R.Nanjai 01677.0 Kannappan S/o.Govindasamy 4.
1782/2C 1782/2 R.Nanjai 03900.5 Ramalingam S/o.Govindasamy
5. Since the Revenue Records does not articulate the claim of the writ petitioner that the canal runs in S.No.1782, this Court finds no merit in the writ petition. Hence, this Writ Petition is dismissed. No order as to costs. (G.JAYACHANDRAN J.)
