PRAYER: Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus, to direct the 2nd respondent to produce petitioner's wife and daughter viz., Shajitha aged about 40 years and his daughter viz., Bowsul Ennaya, aged about 19 years, from the illegal custody of 3rd respondent before this Hon'ble Court and set them at liberty.
For Petitioner : Mr.C.S. Saravanan For Respondents : Mr.R.Muniyapparaj Additional Public Prosecutor assisted by Mr.M.Sylvester John
ORDER
(Order of this Court was made by M.S.RAMESH.J,) When the petitioner's wife and daughter went missing on 23.12.2024, he had given a complaint on 24.12.2024 to the second respondent police, which was registered in Crime No.194 of 2024 under the caption "women missing". Since there was no progress in the investigation to trace the petitioner's wife and daughter, the present Habeas Corpus Petition has been filed.
2. Today, when the matter was called, the learned Additional Public Prosecutor submitted that the complaint preferred by the petitioner has been registered in Crime No. 194 of 2024 as 'woman missing' and that the second respondent police is conducting the investigation to locate the petitioner's wife and daughter.
3. Since the second respondent had registered the petitioner's complaint and are in the process of investigating, we deem it fit that the second respondent could be directed to expedite the investigation and file a final report.
4. In view of this decision, the prayer sought for in the present Habeas Corpus Petition does not require consideration. Accordingly, there shall be a direction to the second respondent herein to expedite the investigation in Crime No.194 of 2024 and file a final report as expeditiously as possible.
5. In view of the above direction, this Habeas Corpus Petition stands closed.
