The petitioner/A1 in Crime No.362 of 2023, registered by the respondent police for the offences under Sections 147, 148, 294(b), 324, 506(ii) & 302 of IPC. The petitioner had been remanded to custody on 20.08.2023, seeks bail. 2.The learned counsel for the petitioner pointed out the long period of incarceration and also pointed out that investigation has been completed and charge sheet has been filed and the learned jurisdictional Magistrate had also committed it to the Court of Sessions and taken on file as S.C.No.219 of 2023, now pending before the the Principal District and Sessions Court, Cuddalore. 3.It is stated that since investigation has been completed, the application for bail can be considered by this Court and in order to provide opportunity to the accused to defend their case.
4.The learned Government Advocate (Crl. Side) for the respondent however raised objections and pointing out the nature of the offences and that 1/3
there was a motive to commit the offence of Section 302 IPC. It is also stated that the petitioner and the other accused were directly engaged in such murder. It is also stated that the case is posted on 02.02.2024 for appearance of the accused. In the order of the learned Sessions Judge, it had been stated that all the accused are in custody and that it was a revenge murder. 5.Let the charges be framed, which would be a significant change of circumstance. At this stage, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed. 19.01.2024 ata 2/3
