ORDER

[Order of the Court was made by M.M.SUNDRESH, J.] The petitioner, who is the father of the detenu, seeks his production before us.

2.It appears from the status report filed that the detenu has been missing from 10.08.2016 onwards. A case was registered in Cr.No.359/2016 for boy missing by the Periyanaickenpalayam https://hcservices.ecourts.gov.in/hcservices/

Police Station namely, the second respondent. This complaint was given by the hostel warden in which the detenu was staying. 3.The status report would reveal that the detenu was depressed having failed in eight papers. In fact, in paragraph 22 of the status report, it has been stated that the profile of the detenu has been updated as early as 07.07.2018. 4.From the above, we are of the view that no one has abducted the detenu. However, the investigation is still on. The earlier petition filed was also closed with the direction to the respondent to proceed with the investigation. We are satisfied with the status report filed.

5.In such view of the matter, the Habeas Corpus Petition stands closed with a direction to the respondents to proceed with the investigation. As and when the detenu is secured, he should be produced before the jurisdictional Magistrate.
