This Criminal Original Petition has been filed to direct the second respondent to register the case based on the complaint given by the petitioner.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. When the matter was taken up for hearing, the learned Additional Public Prosecutor submitted that on a complaint given by the petitioner, a petition enquiry is pending in C.No.32 of 2016 and that, though the petitioner was summoned by the respondent-police, he is not co-operating with the enquiry.

4. Under such circumstances, the petitioner is directed to co-operate with the enquiry and the respondent Police is directed to expeditiously conduct enquiry in accordance with law, as laid down by the Hon'ble Supreme Court in Lalita Kumari V.Government of Uttarpradesh and Others reported in (2014) 2 SCC 1, otherwise the petition may be closed under intimation to the petitioner.

5. With the above direction, this Criminal Original Petition is closed.
