[Order of the Court was made by M.S.RAMESH, J.] This petition has been filed to extent the leave for a period of 28 days to the mother of the petitioner viz., Rajammal w/o. late Bose aged about 70 years from 09.01.2024.

2. The petitioner is the daughter of the detenue. The detenue was initially granted emergency leave for the period between 11.12.2023 and 18.12.2023 by the prison authority since detenue's husband was in a critical condition and thereafter he died on 13.12.2023. In this background, when the petitioner's mother had sought for extension of leave, this Court by order dated 15.12.2023 had granted 21 days medical leave without escort for the period between 19.12.2023 and 08.01.2024. Now, the present application has been filed for further extension of leave.

3. According to the learned counsel for the petitioner, the petitioner's mother is suffering from various medical illness. In support of the said claim, she has also produced records before us. We have taken into consideration of the fact that the petitioner's mother is aged about 70 years and also in view of

the medical ailments, leave could be extended to the detenue for a period of 15 days from 09.01.2024. Accordingly, the present miscellaneous petition is allowed with the following directions:

i) The detenue Rajammal, wife of late Bose, is granted 15 days ordinary leave without escort.

ii) Since the leave granted to the Rajammal expires on 08.02.2024, the ordinary leave shall commence from 09.01.2024 till 24.01.2024.

iii) It is made clear that the detenue need not surrender and the ordinary leave granted today will take immediate effect. iv) The detenue Rajammal shall return back to the prison at 7.00 p.m., on 24.01.2024.

v) The detenue Rajammal shall report before the Inspector of Police, J3 Guindy Police Station, Chennai on every Wednesday at 10.00 a.m., commencing from 10.01.2024.
