Mr.P.Arumugarajan, learned Standing Counsel takes notice for the first respondent and Mr.D.Suriyanarayanan, learned Additional Government Pleader takes notice for the second and third respondents. By consent of the parties, this main writ petition is taken up for final disposal at the admission stage itself.
2. The petitioner seeks for mandamus directing the first respondent to open the TASMAC shop No.4376 situated at Pammal Village, Survey No.114/1 Part, Annasalai Main Road, Pammal Village, Pallavaram Taluk.
3. The petitioner is claiming to be the owner of the above said premises. It is stated that the first respondent has taken the said premises on lease for running the TASMAC Shop.
4. The grievance of the petitioner is that even though the said premises was taken on lease, the TASMAC Shop is not opened so far. Therefore, it is contended that the petitioner has put to financial loss by the conduct of the first respondent.
5. The learned standing counsel appearing for the first respondent submitted that the shop will be opened within a period of four weeks and therefore, the petitioner's apprehension is not well founded.
6. The learned counsel appearing for the petitioner submitted that the above said statement of the learned standing counsel for the first respondent can be recorded and the writ petition may be closed.
7. Accordingly, by recording the submission made by the learned standing counsel for the first respondent, as stated supra, this writ petition is closed. No cost.
