Appeal filed Under Section 96 read with Order 41 Rule 1 of CPC against the decree and judgement of the Principal Subordinate Judge, Salem dated 14.12.1992 in O.S.No.470 of 1981. For petitioner : No appearance For Respondents : No appearance JUDGEMENT The above appeal is listed today i.e. 19.01.2017 for hearing. It is seen from the records that this appeal was actually filed before the District Court, Salem as A.S.No.160 of 1993. By Order dated 11.08.1994 made in Tr.C.M.P.No.17586 of 1993, the above appeal was transferred to this Court to be heard along with A.S.No.962 of 1993.

Similarly, another appeal i.e., A.S.No.161 of 1993 filed before the District Court, Salem was also transferred to this Court and re-numbered as Tr.A.S.No.775 of 1995 by an order dated 11.08.1994 in Tr.CMP No.17588 of 1993. https://hcservices.ecourts.gov.in/hcservices/

None appears for the appellant and the respondents. It is seen from the records that the appeal in A.S.No.962 of 1993 was disposed of on 26.10.2009 as not pressed and the transfer appeal A.S.No.775 of 1995 was dismissed on 21.10.2013 for nonprosecution. Therefore, the present appeal in A.S.No.776 of 1995 is dismissed for non-prosecution.
