Pa dated 18.11.2019 in so far relates to disbursement of the retirement benefits by taking note of G.O.Ms.No.131, dated 4.6.1999 and quash the same and consequently directing the respondents to disburse the terminal benefits of the petitioner like Gratuity, Provident Fund as per U/s.78 and 79 of Tamil Nadu Coop. Societies Act together with earned leave and unearned leave on private affairs together with 18% interest from the date of retirement to the petitioner.

ORDER

This writ petition has been filed to quash the impugned order passed by the 1st respondent in his proceedings Na. Ka. 1135/ 2019/ Sa. Pa dated 18.11.2019 in so far it relates to disbursement of the retirement benefits by taking note of G.O.Ms.No.131, dated 04.06.1999 and consequently, directing the respondents to disburse the terminal benefits of the petitioner like Gratuity, Provident Fund as per U/s.78 and 79 of Tamil Nadu Coop. Societies Act together with earned leave and unearned leave on private affairs together with 18% interest from the date of retirement to the petitioner.

2.When the matter was taken up for hearing today, the learned Additional Advocate General appearing on behalf of the respondents produced the proceedings dated 17.11.2023 issued by the 2nd respondent Society. It is seen from the

proceedings that the 2nd respondents by considering the request made by the petitioner had agreed to release the terminal benefits of the petitioner. Therefore, nothing remains for any further consideration. 3.Hence, this writ petition is disposed of with a direction to the 2nd respondent to implement the undertaking and release the terminal benefits of the petitioner as agreed, within a period of eight weeks from the date of receipt of a copy of this order. No Costs. Consequently, connected miscellaneous petition is closed.
