Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents herein to get back the lands acquired from the petitioner under the Tamil Nadu Act 31/78, viz., a) S.No.6909/2B1 to an extent of 0.14.5 Hectares, b) S.No.690/2B2 to an extent of 0.06.5 Hectares, c) S.No.6990/2B4 to an extent of 0.03.0 Hectares, d) S.No.6909/3A1 to an extent of 0.30.5 Hectares, e) S.No.690/3B to an extent of 0.12.0 Hectares, f) S.No.690/4A1 to an extent of 0.13.0 Hectares, g) S.No.6990/3D to an extent of 0.11.0 Hectares, h) S.No.690/2B3 to an extent of 0.11.5 Hectares, situated at Kettavarampalayam Village, Polur Taluk and convey the same to the petitioner. ORDER

This writ petition has been filed for the issue of a writ of mandamus directing the respondents to re-convey the lands.

2.It will be relevant to take note of the counter affidavit filed by the 1st respondent and the relevant portions are extracted hereunder: 5.The allegations in para 4 are denied. The petitioner has filed several writ petitions in this Hon'ble Court and the same was disposed of as detailed below:

1.W.P.7986/92 dated 5.10.99 Dismissed.

2.W.A.1885/2000 dated 5.3.2001 Dismissed 3 / 6

3.W.P.9444/2001 dated 21.6.2001 Dismissed 4.W.P.19697/2005 dated 18.6.2005 Dismissed The compensation of the lands acquired Rs.1,80,800/- has been remitted under Revenue Deposit into the Sub Treasurey, Polur on 31.3.2001 as the petitioner has not appeared in this office for receiving the compensation amount. The petitioner has received the compensation amount on 14.10.2005 vide cheque No.C.S.009939653 dated 6.10.2005. The possessions of the above acquired land have been taken on 14.6.2001.

6.The allegations in paras 5, 6 and 7 are denied. Necessary house site pattas were issued to 79 persons belonging to Adi Dravidar community after obtaining approval from the District Adi Dravidar Welfare Officer, Tiruvannamalai vide his order K1/20347/2005 date 3.8.2005 on 18.8.2005. 3.In the light of the above development, the relief as sought for by the petitioner cannot be granted by this Court and this writ petition stands dismissed. No costs.
