2024-06-13Honourable Mr Justice R. Subramanian,Honourable Mr.Justice R.Sakthivel2 pages

C.M.P.No.3646 of 2024 in C.M.A.Sr.No.159191 of 2023 R.SUBRAMANIAN, J.

and R.SAKTHIVEL, J.

Mr.E.Kannadasan, learned counsel appears for the respondents 1 to 4.

2. The 5th respondent though served is not appearing either in person or thorough counsel duly instructed.

3. The Insurance Company is on appeal and it seeks condonation of delay of 558 days delay in filing the appeal.

4. Considering the reasons assigned in the affidavit filed in support of this petition to the effect that since the learned counsel for the Insurance Company fell sick he could not apply for the copies of the order in time and therefore the delay occurred, we are of the considered opinion that the delay should be condoned and the Insurance Company should be given an opportunity to contest the appeal on merits. Hence, the delay is condoned. https://www.mhc.tn.gov.in/judis 1/2
