Mrs.S.Pavithra (In all Petitions) MrC.S.K.Sathish for R-3 (In W.P.Nos.1568 & 1575 of 2026) COMMON ORDER These Writ Petitions have been filed to direct the respondents to pay interest @ 6% for the belated payment of Gratuity, P.F and Leave Salary to the petitioners.

2. It is the case of the petitioners that the petitioners, who had joined the services of the respondent Corporation, retired from service in the year 2024, however, the terminal benefits have been settled only on 02.12.2025. Therefore, the petitioners claimed 12% interest on the belated payment of terminal benefits and they have also made representations on 09.12.2025 & 12.12.2025 to pay interest for the belated payment of terminal benefits which has not been evoked any response so far. Hence, the petitioners are before this Court.

3. Heard the learned counsel appearing on either side and perused the materials available on record.

4. In view of the limited request made by the petitioners with regard to interest on the belated payment of terminal benefits, this Court directs the 1st respondent to pay interest @ 6% for the belated payment of terminal benefits from the date of retirement till the date of actual disbursal of terminal benefits of the petitioners, within a period of six (6) weeks from the date of receipt of a copy of this order taking into account the bank rate of interest on deposits.

5. Accordingly, these Writ Petitions are disposed of. There shall be no order as to costs.

Learned counsel appearing for the petitioner brought to the notice of this court that though interest was claimed for gratuity, PF, leave salary and commutation of pension, however, in preamble portion, para-1 and para-4 of the order, the interest to be paid for commutation is not reflected and, accordingly, he prays that necessary correction may be made and fresh order copy may be issued.

3. This Court perused the order dated 23.01.2026 and finds that though interest has been sought for on commutation of pension, however, the same is not reflected in para-1 and 4 of the order dated 23.01.2026.

4. Accordingly, prayer in WP Nos.1568 & 1575 of 2026 in the preamble portion, para-1 and 4 of the order dated 23.01.2026 shall stand replaced with the following paragraphs :- " Prayer in W.P.No.1568 of 2026:

Petition filed under Article 226 of the Constitution of India

Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents to pay interest amounts to me for the belatedly paid Service Gratuity, Provident Fund, Leave Salary and commutation of Pension at the rate of 6% per annum for 18 months of delayed payment in the light of the judgment passed by this Hon'ble Court on 23.10.2024 in W.P.No.30766 of 2024. Para-1:

These Writ Petitions have been filed to direct the respondents to pay interest @ 6% for the belated payment of Gratuity, Provident Fund, Leave Salary and Commutation of Pension to the petitioners.

Para-4:

In view of the limited request made by the petitioners with regard to interest on the belated payment of terminal benefits, this Court directs the 1st respondent to pay interest @ 6% for the belated payment of terminal benefits viz., Service Gratuity, Provident Fund, Leave Salary and commutation of Pension from the date of retirement till the date of actual disbursal of terminal benefits of the petitioners, within a period of six (6) weeks from the date of receipt of a copy of this order taking into account the bank rate of interest on deposits."

5. Registry is directed to carry out the above correction and issue fresh order copy to the parties forthwith. Other portions of the order dated 21.01.2026 shall remain intact.
