This Criminal Original Petition has been filed praying to direct the respondent to register the complaint given by the petitioner dated 29.03.2016.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent and perused the materials placed on record.

3. When the matter was taken up for hearing, the learned Additional Public Prosecutor submitted that the petitioner is an accused in Crime No.437 of 2016 for offences under Sections 448, 323, 427, 379, 506(i) IPC., on a complaint given by one Tajudeen. As a counter blast, the petitioner has given the present complaint dated 29.03.2016 against Tajudeen.

4. On a reading of the complaint dated 29.03.2016, it is alleged by the petitioner that on 11.03.2015, the said Tajudeen has borrowed Rs.16,00,000/- from the petitioner and he has repaid only Rs.1,00,000/-. The respondent-Police has registered the complaint given by the petitioner as CSR.No.86 of 2016. Since the allegation in the complaint is purely money transaction, no positive direction can be given to the respondent to register an FIR., https://hcservices.ecourts.gov.in/hcservices/

5. In view of the above, this Criminal Original Petition is closed with liberty to the petitioner to work out his remedy in the manner known to law.
