C.M.P.No.729 of 2024 in S.A.Sr.No.6792 of 2023 P.T.ASHA, J., This petition is filed to condone the delay of 5 days in filing the above appeal in S.A.Sr.No.6792 of 2023.
2. Heard the learned counsel for the petitioner/appellant. The private notice which has been sent to the sole respondent has been returned "unclaimed".
From the postal endorsement, it is seen that the intimation has been given twice, despite which the addressee has not claimed the notice. Therefore, there is a deemed service on the respondent.
3. Considering the fact that sufficient reasons have been given in the affidavit filed in support of the petition, the delay is condoned and the petition is allowed.
4. The Registry is directed to number the appeal, if it is otherwise in order and list the same for admission.
