ORDER

This Criminal Original Petition has been filed by the petitioner/A3 to quash the proceedings in C.C.No.3026 of 2011, pending before the 8th Metropolitan Magistrate Court, George Town, Chennai.

2. When the matter came up for hearing in the last occasion, there was no representation on behalf of the petitioner. Though the Criminal Original Petition, which arouse out of a proceedings under Section 138 read with 141 of the Negotiable Instruments Act, is admitted as early as in the year 2011, notice as regards the respondent was not yet served. It is also seen from the records that private notice was ordered on 15.06.2017 and 07.03.2018. But, it appears that no steps have been taken to serve notice on the respondent and no proof affidavit was filed till date. Under the above circumstances, this Court directed the Registry to post the matter under the caption 'for dismissal' on 27.11.2018.

3. Even today, ie., on 27.11.2018, none appeared on behalf of the petitioner. In such a view of the matter, this criminal original petition is dismissed for non-prosecution.
