Crl.M.P.1007 of 2020 in Crl.R.C.No.1270 of 2019 Crl.M.P.No.1007 of 2020 in Crl.R.C.No.1270 of 2019 P.VELMURUGAN.J., The defacto complainant filed a petition to implead the petitioner herein as second respondent in the Criminal Revision petition. 2.Based on the complaint given by the defacto complainant the prosecution agency taken the case for investigation and laid the charge sheet and altered the offence against the accused persons. 3.Before the trial Court the defacto complainant has not been impleaded as a party. Therefore, the defacto complainant need not be impleaded as a party in this present revision also. Accordingly, the miscellaneous petition is liable to be dismissed. However, the liberty is granted to the defacto complainant to assist the prosecution in the main case pending before the trial Court.
