A.No.215 of 2020 in C.S.No.214 of 2004 A.No.215 of 2020 in C.S.No.214 of 2004 C.V.KARTHIKEYAN,J., This application has been filed seeking to implead the third respondent as a third defendant in the suit and consequently to permit the applicant/plaintiff to amend the short and long cause title and also the statement of addresses in their plaint.
2. In the affidavit filed in support of the application, it had been stated that the first defendant Company has been wound up by an order of the National Company Law Tribunal dated 12.10.2018 in M.A.No.453 of 2018. It was stated that the Tribunal had also appointed Mr.Ramakrishnan Sadasivan as liquidator to be in-charge of the first defendant's Company.
3. Heard learned counsel for the defendants also.
4. Notice had also been served on the said third defendant to the office of the official liquidator.
5. In view of the fact that the liquidator appointed by the NCLT is a necessary party in the proceedings, the application is allowed. 1/2 http://www.judis.nic.in

The Registry is directed to carry out the necessary amendment in the application since it would be practically impossible for the learned counsel for the plaintiff to carry out the said amendments. The learned counsel for the plaintiff may forward an amended copy of the plaint to the first defendant and also to the newly impleaded third respondent/third defendant for the hearing date on 15.09.2020.
7. List the matter once again on 15.09.2020.
