Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus, to direct the first respondent to consider the Petitioner representation dated 14.11.2023 and direct the first respondent to sanction the PTPF amount standing in the credit of Late D.Jansirani together with interest to the petitioner and consequently direct the second respondent to draw and disburse the said amount immediately. ORDER
This writ petition has been filed for direction directing the first respondent to consider the Petitioner representation dated 14.11.2023 and direct the first respondent to sanction the PTPF amount standing in the credit of Late D.Jansirani together with interest to the petitioner and consequently direct the second respondent to draw and disburse the said amount immediately.
2. Heard the learned counsel on either side and perused the materials available on record.
3. The petitioner's mother's sister worked as full time Vocational Instructor in the Panchayat Union Middle School, Nolambur from 28.10.1986 and died on 24.04.2015. She had no issues. Therefore, she nominated the petitioner's mother as a nominee to receive her retirement cum death benefits. His mother also died on 26.01.2021. The petitioner is the only surviving legal heir of his mother. The legal heirship certificate was also issued dated 15.07.2015. The first respondent by its proceedings dated 03.10.2017 authorized the Death Gratuity to the tune of Rs.4,94,824/- in favour of the petitioner. Accordingly, he was paid the said amount. Now, the amount standing at the Panchayat Teachers Provident Fund account has been paid in
favour of the petitioner in respect of the deceased D.Jhansirani. Therefore, the petitioner submitted a representation and the first respondent by its proceedings dated 02.01.2023 required records such as GPF Nomination duly filed by the Government Servant while she was alive, legal heirship certificate and order /succession certificate.
4. Though the petitioner submitted the legal heirship certificate, now he was asked to produce succession certificate. Therefore, the petitioner submitted another representation on 14.11.2023, to pay the amount standing in the credit of Late D.Jansirani together with interest to the petitioner, since he is the only legal heir.
5. Considering the above, the first respondent is directed to consider the representation submitted by the petitioner dated 14.11.2023 and pass orders on merits and in accordance with law, to disburse the dues in favour of the petitioner, within a period of eight weeks from the date of receipt of a copy of this order.
6. With the above directions, this writ petition is disposed of. There shall
be no order as to costs.
