The petition is filed seeking to condone the delay of 128 days in representation of CMA.SR.No.60916/2019 filed against the order passed in EIOP.No.245/2005 dated 23.10.2018 by the Presiding Officer, Employees Insurance Court (Principal Labour Court), Chennai. 2.

Learned Counsel for the petitioners submits that the appeal which was originally filed was returned for curing certain defects by the Registry and after rectification, the same was represented with a delay of 128 days. The reason being that due to Covid-19 pandemic situation, the learned Counsel for petitioner was afraid to visit the Registry to cure the defects. Therefore, in view of the lock down announced by both the Central and State Governments, the delay has occurred. Hence, the delay may be condoned, it is pleaded.

3. No representation for the respondent despite notice was served on them.

4. Being satisfied with the reason stated by the learned Counsel for the petitioners that due to covid-19 pandemic situation, he was afraid to visit the Registry to cure the defects, the delay is condoned and the petition is ordered accordingly.
