ORDER

To strike off the proceedings in E.P.No.699 of 2023 initiated by the respondent/decree holder on the file of XII Small Causes Judge, XII Small Causes Court, Chennai, the revision petitioner/judgment debtor had preferred this Civil Revision Petition.

2. Considering the facts and circumstances of the case, the learned XII Small Causes Judge, XII Small Causes Court, Chennai is directed to take the petition seeking to set aside the exparte decree along with condone delay petition filed on 14.12.2023 filed by the revision petitioner on file and to decide the same on merit by giving opportunity to both parties within a period of eight weeks from the date of receipt of copy of this order. Till then, all further proceedings in E.P.No.699 of 2023 pending on the file of XII Small Causes Court, Chennai is not to be proceeded. With that direction, this Civil Revision Petition is disposed of. No costs. Consequently, the connected civil miscellaneous petition is closed.
