Mr.S.Santhosh, Government Advocate (Crl. Side) Order This Criminal Original Petition has been filed seeking to quash the proceedings against the petitioner in PRC.No.31 of 2024 pending on the file of the learned District Munsif -cum- Judicial Magistrate, Vedaranyam.

2.The learned counsel appearing for the petitioner would submit that the respondent, without conducting a proper investigation, within four days from the registration of the case, have filed final report and further, all the witnesses are official witnesses and there is no independent witness in this case. He would further submit that the further proceedings against the petitioner is nothing but an abuse of process of law.

3.The learned Government Advocate (Crl. Side) appearing for the respondent would submit that the mere fact that all the witnesses are official witnesses cannot be a ground for quashing the impugned proceedings. 4.At this juncture, the learned counsel appearing for the petitioner sought permission of this Court to withdraw this Criminal Original Petition and also made an endorsement to that effect. Further, he sought the indulgence of this Court, to dispense with the personal appearance of the petitioner before the Trial Court.

5.In view of the submission and the endorsement made by the learned counsel appearing for the petitioner as regards withdrawal, this Criminal

Original Petition is dismissed as withdrawn. Consequently, the connected Miscellaneous Petitions are closed. However, acceding to the request of the learned counsel for the petitioner, the personal appearance of the petitioner before the Trial Court is dispensed with, except for receipt of copies, answering the charges, questioning under Section 313 of Cr.P.C., passing of judgment, or any other date as may be required by the Trial Court. However, it is made clear that the petitioner shall be duly represented by his counsel before the Trial Court.
