Though this Commercial Division had taken cognizance of the suit on 11.09.2020, it is seen that no order was passed under proviso to Subsection 4 of Section 15, prescribing a time limit within which, the written statement should be filed. The instant application has been filed seeking permission to file written statement. The written statement is filed on 05.01.2021.

2.Considering the fact that the delay is not much, I am inclined to accept the written statement. Therefore, A.No.2186 of 2021 is allowed, the written statement of the 2nd defendant is taken on file. 3.Parties are required to file their affidavits of admission / denial by 20.07.2021.
