C.M.P.No.3396 of 2023 in C.M.A.Sr.No.117888 of 2022 N.ANAND VENKATESH , J This Civil Miscellaneous Petition has been filed seeking to condone the delay of 95 days in filing the Civil Miscellaneous Appeal.
2. Notice has been served on the learned counsel, who appeared for first respondent before the Tribunal and affidavit of service has also been filed in SR No.24117 of 2024.
3. Mr.S.V.Karthikeyan, learned counsel, takes notice on behalf of second respondent.
4. Mr.B.Tamilnidhi, learned Additional Government Pleader, takes notice for respondents 3 to 5.
5. Heard learned counsel on either side.
6. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 95 days in filing the above appeal is condoned.
7. Registry is directed to number the main Civil Miscellaneous Appeal, if it is otherwise in order and list the same for admission in due course.
Registry is directed to print the name of Mr.S.V.Karthikeyan, learned counsel for second respondent and Mr.B.Tamilnidhi, learned Additional Government Pleader, appearing for respondents 3 to 5 at the time of admission.
