ORDER

Apprehending arrest in connection with Crime No.222 of 2024 registered for the offences punishable under Sections 8(c), 20(b)(ii)(C), 25 and 29(1) of NDPS Act, the present petition has been filed seeking anticipatory bail.

2. Pleading innocence on the part of the petitioner, false implication

in the case, learned counsel for the petitioner seeks indulgence of this Court. Learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.

3. The case of the prosecution as putforth by the learned Government Advocate (Crl.Side) appearing for the respondent is that the petitioner was in possession of commercial quantity of ganja which was sold. He further submits that the petitioner has two previous cases under NDPS Act. He further submits that the Hon'ble Apex Court, while granting anticipatory bail in the matters involving commercial quantities has expressed grave concerns.

4. Having heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record and taking into consideration of the commercial quantity of ganja and the petitioner has two previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. 09.01.2025 mn
