police for the offences punishable under Sections 118(1), 3(5), 351(3) of BNS, 2023 and thereafter altered to 296(b), 118(1), 109(1) and 351(3) r/w 3(5) of BNS, 2023, in Crime No.253 of 2024, on the file of the respondent police, seeks anticipatory bail.

2. It is the case of the prosecution that, due to previous enmity, the petitioner, along with other accused went to the defacto complainant's house and picked up quarrel. During quarrel, the accused abused the defacto complainant using filthy language and assaulted him with knife. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that even as per the prosecution, the injured has been discharged from the hospital. Therefore, he prays to grant anticipatory bail to the petitioner.

respondent police, on instructions submitted that the petitioner/ accused is a history sheeter and that there are four previous cases pending against the petitioner. He would further submit that injured has been discharged from the hospital. However, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Heard the learned counsel appearing for the petitioner, the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record.

6. Considering the nature of allegations and that the petitioner is as a history sheeter and having four previous cases of similar nature, this Court is not inclined to grant anticipatory bail to the petitioner.
