V.Senthil Kumar v. The Commissioner

2023-01-06Honourable Mr Justice M. Sundar2 pages

W.M.P.No.236 of 2023 in W.P.No.251 of 2023 W.M.P.No.236 of 2023 in W.P.No.251 of 2023 M.SUNDAR, J., This order will now dispose of the captioned 'Writ Miscellaneous Petition' ['WMP'].

2. Captioned WMP has been filed under Rule 15 of 'Madras High Court Writ Rules, 2021' [hereinafter 'Writ Rules 2021' for the sake of convenience and brevity] by two petitioners with a prayer to file a single writ petition.

3. Adverting to paragraph No.6 of support affidavit, Mr.P.Dinesh Kumar, learned counsel on record for writ petitioner submits that the cause of action is common. This averment is sketchy and in the days to come, such averments may have to meet negative consequence. However, making an exception this writ Court notices from the case file that two petitioners are siblings, they are co-owners of immovable property qua which the property tax demand has been made and challenge to such property tax demand is the subject matter of the main writ petition. Rights sought to be asserted are the same. The source of rights is the same and the prayer is common.
