Application No.258 of 2022 in C.S.No.402 of 2020 (Comm.Suit) N.ANAND VENKATESH, J ., This application has been filed by the 2nd defendant to condone the delay of 306 days in filing the written statement.

2.Heard Mr.Preethi S.Arasu, learned counsel for the applicant and Mrs.S.Gayathri, learned counsel for the 1st respondent/plaintiff.

3.It is seen from the office note that the 2nd defendant was served with the summons on 02.02.2021. The written statement ought to have been filed before 02.03.2021 and the maximum condonable delay is 120 days. However, technically there may not be any delay in filing the written statement by virtue of the orders passed by the Hon'ble Supreme Court in MA.No.665 of 2021 dated 23.09.2021 and which was further extended by an order dated 10.01.2022. In view of the same, the written statement can be taken on file.
