Respondents PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, directing the respondents to alter the offence under Section 323, 342, 350 of IPC and include the sections 211, 217, 219, 228, 294(b), 324, 352 and 506(ii) of IPC in Crime No.1143 of 2020 dated 12.12.2020 on the file of the Perumbalai Police Station.

ORDER

This Criminal Original petition has been filed seeking for a direction to the respondent police to alter the First Information Report in Crime No.1143 of 2020 on the file of the second respondent Police.

The learned Additional Public Prosecutor, on instructions, submitted that the First Information Report was registered only on 12.12.2020 for an offence under Sections the offence under Section 323, 342, 350 of IPC. The investigation is in progress. If in the course of investigation, the respondent police collect sufficient materials, the offenses will be altered accordingly.

3. In view of the above submission, there shall be a direction to the respondent Police to continue with the investigation effectively and based on the materials collected during the course of investigation, either alter the FIR or file the final report by adding the necessary offences made out.

4. This Criminal Original Petition is disposed of accordingly.
