Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus to the first respondent to dispose of the appeal dated 07.12.2012 filed by the petitioner for cancelling the appointment of the 5th respondent as Anganwadi Worker of Child Welfare Centre at Sundekuppam Anganwadi Center in Krishnagiri Block and appoint the petitioner in the said place.

R D E R The petitioner has filed this writ petition seeking issuance of Writ of Mandamus to the first respondent to dispose of the appeal dated 07.12.2012 filed by the petitioner for cancelling the appointment of the fifth respondent as Anganwadi Worker of Child Welfare Centre at Sundekuppam Anganwadi Center in Krishnagiri Block and to appoint the petitioner in the said place.
2.The case of the petitioner is that the petitioner belong to Most Backward Class and a permanent resident of Sundekuppam Village, Krishnagiri Taluk and District. The petitioner has passed S.S.L.C. Examination during March, 1995. The petitioner applied for the post of Anganwadi Worker in Sundekuppam Anganwadi Centre, Kaveripattinam Union, Krishnagiri District during June - July, 2012. The petitioner was called upon by the fourth respondent to attend the interview on 07.08.2012 and the petitioner also attended the interview.
3.It is the further case of the petitioner that while she was eagerly awaiting the orders of appointment, she came to know that the fifth respondent, who is a resident of Periyamuthur Village, Krishnagiri Union, has been appointed as Anganwadi Worker of Sundekuppam Centre. Hence, the petitioner preferred appeal dated 07.12.2012 before the first respondent, requesting to cancel the appointment of the fifth respondent and to appoint the petitioner in the said place and since there is no response has filed this writ petition.
4.The learned counsel appearing for the petitioner would submit that this Court may issue direction to the first respondent to dispose of the appeal preferred by the petitioner dated 07.12.2012, after giving opportunity to the petitioner and the fifth respondent.
5.The learned Special Government Pleader appearing for the respondents 1 to 4 has no serious objection for this Court issuing such a direction.
6.In view of the above, this Court without expressing any opinion on the merits of the case, directs the first respondent to dispose of the appeal preferred by the petitioner dated 07.12.2012, on merits and in accordance with law, after giving opportunity to the petitioner and the fifth respondent, within a period of three months from the date of receipt of a copy of this order.
