Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned reversion order passed by the 1st respondent vide order in ROC.No.03-A/2024/Con.C1 dated 27.12.2024 and quash the same and consequently direct the 3rd respondent, to continue the petitioner in the post of Chief Administrative Officer, Principal Labour Court, Vellore. O R D E R
(Order of the Court was made by R.SUBRAMANIAN, J.) Challenge is to the order dated 27.12.2024, transferring the petitioner, who was working as Chief Administrative Officer, Principal Labour Court, Vellore, as Sherishtadar of the Principal District Court, Krishnagiri. 2.
It is the claim of the petitioner that this transfer amounts to reversion as the post of Chief Administrative Officer carries a higher grade pay. The petitioner was temporarily promoted as Chief Administrative Officer by the proceedings of the Registrar General dated 22.01.2024. 3.
The person above the petitioner, one Umashankar, was not considered for promotion at that point of time since some disciplinary proceedings were pending against him. Upon conclusion of the disciplinary proceedings, the said Umashankar was cleared of the charges and therefore, he was entitled to be promoted as Chief Administrative Officer. 2/6
4.
In view of this contingency, the petitioner was reverted as Sherishtadar and posted at the Principal District Court, Krishnagiri, while Umashankar was transferred and posted as Chief Administrative Officer, Principal Labour Court, Vellore.
5.
The petitioner's promotion itself being temporary in nature, he cannot claim any vested right to be retained in the post of Chief Administrative Officer. The fact that Umashankar is senior to the petitioner not being disputed, we do not think that the respondents can be faulted for reverting the petitioner as Sherishtadar and posting him at the Principal District Court, Krishnagiri.
6.
We therefore see no reason to interfere with the impugned order in the writ petition. The Writ Petition fails and it is accordingly dismissed. No costs. Consequently, connected Miscellaneous Petitions are closed.
