ORDER

(Order of the Court was made by P.VELMURUGAN, J.) This Criminal Miscellaneous Petition has been filed seeking suspension of sentence imposed on the petitioner by the learned Sessions Judge, Special Court for Exclusive Trial of Cases under SC/ST (PoA) Act, Villupuram, in Spl.S.C.No.13 of 2020 dated 30.09.2024 and enlarge the petitioner on bail, pending appeal. It is seen that even though charges framed under the provisions of SC/ST (PoA) Act, the learned trial Judge not found the accused guilty for the offence under the provisions of SC/ST (PoA) Act and neither the State nor the Defacto complaint filed any appeal against the acquittal of the accused for the offence under the SC/ST (PoA) Act. Hence the defefacto complainant need not be heard before passing any order in this petition seeking suspension of sentence as represented by the learned counsel for the petitioner.

This Criminal Appeal is pending from the year 2025. It is seen that typed set of papers are being made ready and this Court is inclined to hear the main appeal itself and hence this miscellaneous petition seeking suspension of sentence is 2 / 4

closed.
