Both these applications have been filed to restore A.Nos.4082 and 4083 of 2013 which have been dismissed for non-prosecution on 24.01.2017. A.No.4082 of 2013 is an application seeking leave to sue against the 2nd defendant in C.S.D23136 of 2013. A.No.4083 of 2013 is an application seeking leave to file the suit. Both the applications had been dismissed for non-prosecution on 24.01.2017. 2.

The application seeking to condone the delay in filing the application seeking to restore the applications had been allowed earlier. These applications are therefore consequential in nature. Taking that factor into consideration, both A.Nos.2204 and 2206 of 2024 stand allowed.
