ORDER
The petitioners assert that a suit for partition was filed by the first petitioner and two others before the District Munsif Court, 2/5
Gummidipoondi and that preliminary decree dated 11.02.2020 was issued in the said suit. While the application for final decree is pending, it is stated that a release deed was executed by the eighth respondent in favour of the ninth respondent and registered as Document No.6795 of 2025. After submitting a representation seeking cancellation thereof, the present writ petition has been filed.
2. Mr.S.Jayachandran, learned Government Advocate, accepts notice for respondents 1 to 7 and 11.
3. Admittedly, partition suit by and between some of the parties herein is pending. All the relevant facts relating to the claims made by the parties over the relevant immovable properties is before the said Court. In those circumstances, in summary proceedings before this Court, such title disputes cannot be appropriately addressed. Therefore, by leaving it open to the petitioners to approach the Civil Court for relief, this writ petition is disposed of. There shall be no order as to costs. 12.02.2026 Index:Yes/No mmi 3/5
