The petitioner/A3 in Crl.O.P.No.600 of 2024 , who was arrested and remanded to judicial custody on 05.06.2023, for the offences under Sections 120(b),341,147,148,307,302 r/w 149 of I.P.C in crime No.381 of 2023 seeks bail.
2. The petitioner/A1 in Crl.O.P.No.659 of 2023 who was arrested and remanded to judicial custody on 06.06.2023, for the offences under Sections 120(b),341,147,148,307,302 r/w 149 of I.P.C in crime No.381 of 2023 seeks bail.
3. Strong objection had been raised on behalf of the respondents. The learned Government Advocate submitted that owing to the antecedents of A1 as seven previous cases were registered against him, he was detained under Tamil Nadu Act 14 of 1982 for four times. 1/3
He underwent detention for two times. On two other occasion, detention order was revoked. It is pertinent to note that one previous case was under NDPS act and another under Section 397 of I.P.C.
4. It is the case of the prosecution that owing to previous motive and as a retaliation, all the accused persons had followed the deceased and murdered him. Now the matter has been committed before learned II Additional District and Sessions Judge, Thiruvallur at Poonamallee in S.C.No.216 of 2023. A direction is given to the learned Sessions Judge to frame charges and thereafter as early as possible record the evidence in chief and cross examination of the injured witnesses.
5. At this stage, bail application cannot be considered. Hence, these Criminal Original Petition stands dismissed. 12.02.2024 smn 2/3
