ORDER

The petitioner, who was arrested and remanded to judicial custody on 24.07.2025 in S.C.No.12 of 2022 on the file of Additional Assistant Sessions Judge, Tiruvannamalai, for the offences punishable under Sections 392 and 397 of I.P.C in Crime No.2451 of 2020 , registered on the file of the respondent police, seeks bail.

2.The petitioner is facing trial in S.C.No.12 of 2022 on the file of Additional Assistant Sessions Judge, Tiruvannamalai, He has not appeared before the Trial Court regularly. Hence NBW was issued against him on 11.07.2023 and the same was executed on 24.07.2025. 3.The learned counsel appearing for the petitioner submitted that due to his health condition the petitioner was not able to appear on the date of hearing before the Trial Court for the case in S.C.No.12 of 2022 on the file of Additional Assistant Sessions Judge, Tiruvannamalai and due to his nonappearance before the Trial Court NBW was issued as against the petitioner on 11.07.2023 and subsequently, the petitioner was arrested on 24.07.2025 day. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioners, reiterated the prosecution case and submitted that out of 12 witness only LW4 was not examined and all other witness were examined. He further submitted that the matter is posted for examination of LW.4 on 21.01.2026. 2/4

Considering the fact that the trail is at final stage and only one witness is yet to be examined, at this stage if bail was granted to the petitioner, there is a likelihood that the petitioner may abscond and the trial process will also get affected. Hence, this Court is not inclined to grant bail to the petitioner.
